I would like users to agree to the 'terms of use' prior to submitting the form. Can I add a link to the form so that users agree to this first?

I'd simply put a required check box on your form that says something to the extent:

"I agree to the Terms of Service"

I would then paste the new html to your site and manually place a link to your terms of service next to this question.
